Terms and Conditions
Thalassa Pearls: Terms and Conditions of Salea lawyer review it before publishing.
1. About these terms
1.1 These terms apply to every purchase made through thalassapearls.com.au (the site).
1.2 By placing an order you agree to these terms. Please read them before you buy.
2. Orders, prices and payment
2.1 All prices are in Australian dollars (AUD) and include GST where applicable.
2.2 An order is accepted only when we confirm it by email or dispatch the goods. We may decline or cancel an order, for example if an item is unavailable, if there is a pricing or description error, or if we cannot verify the payment or delivery details. If we cancel, we will refund any amount you have paid.
2.3 Payment is taken at checkout by the methods shown on the site. For higher-value orders we may ask you to confirm your identity before we dispatch the goods.
3. Shipping and delivery
3.1 Free shipping applies to orders delivered within Australia. Delivery is by Australia Post with tracking.
3.2 We aim to dispatch in-stock items within [3] business days of confirming your order. Delivery times are estimates, not guarantees. Made-to-order and custom items take longer, and we will tell you the expected time before you pay.
3.3 Orders over AUD $[2,000] are sent insured and may require a signature on delivery. Please make sure someone can receive the parcel.
3.4 Ownership of the goods passes to you when you pay in full. Risk of loss or damage passes to you when the goods are delivered to the address you gave us.
3.5 For orders outside Australia, you are responsible for any customs duties, import taxes and clearance fees charged by the destination country.
4. Natural products
4.1 Pearls are natural, organic gems. Shape, colour, surface markings, lustre and size vary from pearl to pearl, and no two are identical. Photos are a guide only, and screens show colours differently.
4.2 Normal variation in a pearl's natural characteristics, within the description on the product page, is not a fault.
5. Returns for change of mind
This section applies when you simply change your mind. It does not apply to faulty or misdescribed goods, which are covered in section 6.
5.1 We do not have to accept a return if you have changed your mind, but we will consider requests. Returns are by our approval only, and we must approve the return in writing before you send anything back.
5.2 To ask for approval, email thalassapearls@gmail.com within [14] days of delivery with your order number, the item and your reason for the return.
5.3 If we approve the return, we will send you a return authorisation number and a return address. Goods sent back without our written approval may be refused, and we may return them to you at your cost.
5.4 To be accepted, the goods must be unworn, unaltered and undamaged, and returned in their original packaging with all certificates, cards and tags. We cannot accept earring returns due to hygiene issues.
5.5 You are responsible for the cost of sending the goods back to us. Please use a tracked and insured service. The goods remain at your risk until we receive them, so we cannot be responsible for goods lost or damaged on the way back to us.
5.6 A restocking fee of AUD $15 applies to each approved return. We deduct it from your refund.
5.7 When we receive and inspect the goods, we will refund the price you paid, less the restocking fee, to your original payment method within [10] business days. If the goods do not meet the conditions in 5.4, we may refuse the return or deduct an amount for the loss in value.
5.8 We do not accept change-of-mind returns for custom, bespoke or made-to-order items (including custom lengths), items we have altered or engraved at your request, or goods damaged after delivery.
6. Consumer guarantees
6.1 Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure. You are also entitled to have the goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.
6.2 If goods are faulty, are not as described, or arrive damaged, contact us as soon as you can at thalassapearls@gmail.com, with photos if possible. We will offer the remedy you are entitled to under the law.
6.3 Sections 5.1 to 5.8, including the approval requirement, the cost of return postage and the restocking fee, do not apply to a remedy you are entitled to under the Australian Consumer Law. We will pay the reasonable cost of returning goods that are faulty or not as described.
6.4 Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or other law that cannot be excluded.
7. Descriptions and grading
7.1 Product pages describe each pearl's type, size, shape, shade, lustre and surface. Unless a page says the pearl has been independently graded or certified, these descriptions are our own assessment using the scale explained at [link to grading key].
7.2 Where we supply a certificate or valuation, it is listed on the product page and forms part of the sale.
8. Custom and made-to-order items
8.1 Custom lengths, bespoke designs and made-to-order pieces are made specifically for you. We will confirm the details, price and timeframe in writing before you pay. Section 5.8 applies to them, and section 6 still applies if they are faulty or not as agreed.
9. Privacy
9.1 We collect and use your personal information to process orders, deliver goods, provide support and, with your consent, send marketing. You can opt out of marketing emails at any time.
10. Our responsibility
10.1 Subject to your rights under the Australian Consumer Law and other laws that cannot be excluded, we are not liable for indirect or consequential loss, such as lost opportunities or lost profits.
10.2 We are not responsible for delays caused by events outside our control, such as weather, carrier disruption or customs holds. We will tell you promptly if your order is affected.
11. Changes and governing law
11.1 We may update these terms from time to time. The terms in force when you place your order apply to that order.
11.2 These terms are governed by the laws of [Western Australia], and you agree to the courts of that State, without limiting any rights you have under the Australian Consumer Law.
